This agreement (the “Agreement”) is entered into by and between you and FrameEasy Kenya regarding your use of frameeasy.co.ke website (“Website”). By using the Website, you are entering into this Agreement with Frames Mart and indicating that you agree to be bound by these terms and conditions. If you do not agree with these terms and conditions, please do not use the Website. FrameEasy reserves the right to alter the terms and conditions as it pleases and without prior notice.
1. Definitions
– The customer is the person or party who purchases the Products from the Seller.
– The seller is FrameEasy Kenya.
– FrameEasy Kenya website is the frameeasy.co.ke website.
– The visitor is the person or party who visits the website.
2. Use of customer information
All information that a Customer provides for the purpose of processing an order shall be treated confidentially. We shall not share Customer information with any unauthorized persons. We may share Customer information with our business partners who assist in the delivery or any other service that is pertinent to the processing of the Customer’s order.
3. Content on the website
FrameEasy endeavors to ensure that the information presented on the Website is as accurate as possible. FrameEasy Kenya takes no liability to any Visitor for incorrect, unlawful, or unreliable information presented on the Website.
4. Trademarks
All the information including and not limited to trademarks, names, logos, images, and text displayed on the Website is the property of FrameEasy Kenya. Nothing including and not limited to the above-mentioned items contained on the Website should be copied, reproduced, or manipulated without our prior written permission of us.
5. External links
External links provided to the Customer on the Website are beyond the control of FrameEasy Kenya. We, therefore, take no responsibility for any outcome resulting from access to it.
6. Order process
Any order placed by the Customer is subject to final acceptance by the Seller. Once the Seller receives an order from the Customer they may send an order acknowledgment message with the details of the products in the order. An acknowledgment message does not count as an order confirmation. An order will be confirmed once the Seller receives confirmation of payment. For any rejected or unfulfilled order, the Customer will receive a full refund for the amount paid for the order.
7. Description and pricing
The description of the products is displayed on the Website at the time the Customer places an order with samples, drawings, descriptive matter, specifications, and advertising for the sole purpose of giving an approximate idea of the products described.
Every effort is made by the Seller to ensure that prices shown on the Website are accurate. If an error is found, the Seller will inform the Customer as soon as possible and offer the option of reconfirming the order at the correct price or canceling the order.
All prices are shown in KES (Kenyan Shillings) and unless expressly stated otherwise, including Tax (where applicable) at the applicable current rates, but do not include delivery charges.
8. Delivery
Delivery of the Products shall be made as specified by the Customer. They can be delivered to the Customer’s address or the Customer can pick them up from our premises.
The Customer acknowledges that it may be required by the Seller to provide proof of address and identification prior to delivery being made.
Any dates specified by the Seller for delivery of the Products are intended to be an estimate and time for delivery shall not be made of the essence by notice. If no dates are so specified, delivery shall be within a reasonable time.
Delivery costs are not included in the prices quoted on the Website. When placing an order on the Website, the Customer is provided with the option to determine the terms of delivery.
9. Payment
Payment for the Products by the Customer is to be made using the secure method provided on the Website provided by a third-party entity. The information passed on the Website is securely passed over an encrypted connection to ensure the safety of Customer information. The SSL certificate is provided by a licensed Certification Authority.
10. Warranties and disclaimers
FrameEasy makes no warranties, representations, statements, or guarantees in any form regarding the Website and its use. FrameEasy shall not be responsible for and disclaims any liability for any loss, liability, damage (direct, indirect, or consequential), injury, or expense that may occur as a result of your access and/or use of the Website and any information contained on the Website.
By accessing and using our Website you waive any and all claims you may have against FrameEasy with respect to the above-mentioned.
